POLICE COURT

MONDAY, MAY 4. (Before Mr H. W. Bundle, S.M.) DRUNKENNESS. Joseph Enoch Horsfall and. John Theodore Noble Forsythe were each fined £l, in default 24 hours’ imprisonment. Horace Martin was convicted and discharged. NEGLIGENT DRIVING, “ I quite appreciate that the tram stop is improperly noted as being 21yds from the actual stopping place,” said the Magistrate in giving his decision in a case in which Eugene Daniel Liston (Mr E. J. Anderson) was charged with negligent driving. Liston was involved in a collision with a pedestrian who was about to get oil a tram car at the intersection of George and Dundas streets. “ The controlling authorities should have the signal at the proper stop,” said His Worship. “ There should be a careful examination by them, not only of this spot, but of others.” The Magistrate found that negligence had been proved, although the defendant was proceeding at a reasonable pace and showed some skill in manoeuvring his car. Liston was convicted and fined £2 and costs. ASSAULT CASE. Joseph Sutherland appeared for sentence on charges of assaulting his daughter and using obscene language. Remarking that Sutherland had been in custody since Friday, the Magistrate adjourned the assault charge for 12 months, and on the other convicted and ordered him to come up for sentence if called upon within that time. Sutherland agreed to take out a Prohibition order. REMAND GRANTED. Keith Mitchell was charged with being in a state of intoxication while in charge of a car. Mr L. R. Simpson asked for a remand for a week, and this was granted. Mitchell was allowed l bail in self of £25 and one surety for a similar amount. He was directed not to drive a car in the meantime. CRASHED INTO TRUCK. Hugh Trounce MVDonald (20) pleaded guilty to a similar charge. Sergeant O’Shea told the court that M'Donald crashed into a truck in the parking area outside First Church at 12.20 yesterday morning. He was accompanied by another young man called James Raymond Sloan, who was the owner of the car, and who held a driving license. M'Donald said that he had a license but could not produce it. Both car and truck were badly damaged. “ A driver who is in full possession of his faculties is dangerous enough in bad weather, but a man who is intoxicated is an absolute menace,” said His Worship. Sloan was then charged with the same offence, and also pleaded guilty. The police said that both came from Oamaru. Both were remanded in custody until Friday. WORSE FOR LIQUOR. Henare To Rahu (37) also pleaded guilty to a charge of being intoxicated while in charge of a truck in Lower Stuart street. Sergeant O’Shea said Rahu and another man were seen trying to start a truck at 1.15 yesterday morning. Both were the worse for liquor. , The Magistrate: I’ve seen you before, Rahu. Rahu: Yes, sir. The Magistrate; You are prohibited, are you not? Rahu: Yes, sir. His Worship said that Rahu was an irresponsible type, and remanded him until the afternoon to enable further inquiries to be made from the Oamaru police about him. - - - After hearing the reports this afternoon, the Magistrate remanded Rahu in custody until Friday. DISORDERLY CONDUCT. Harry Corsar pleaded guilty to charges of drunkenness, using obscene language, and committing mischief by smashing two window panes. Sergeant O’Shea said that Corsar, who was in a drunken condition, called at a house in Moray Place at 11 p.m. on Saturday. He said that he wanted to see a girl who lived there and, When he was told that she was not in, forced his way into the house. He was put out by the girl’s father twice, and then kicked the door and put his fist through a window above the door. He next went across the street and used the language complained of. His hand was badly cut and had to be dressed at the hospital. Corsar was fined £2 and costs, and was ordered to make good the damage to the window. His Worship suggested that his first action should bo to go and apologsie to the girl for his conduct. Corsar; I will, sir. MAINTENANCE. Frank Sturgeon, charged with disobedience of a maintenance order, the^

arrears of which amounted to £6l 17a 9d, was sentenced to three months’ imprisonment, the warrant to be suspended if he pays £lO forthwith and £.3 by June 4. The arrears over £ls were remitted. Harold Joseph Kitto, whose maintenance payments were in arrears to tho extent of £3 Is 6d, was sentenced to one month’s imprisonment, the warrant to be suspended if he pays £1 10s by May S.
