Further evidence was heard in the Magistrate’s Court yesterday afternoon in the case in which Jessie Kirkland claimed' from William Pryde the sum of £lB 19s 6d as rent of a Green Island farm leased to the defendant at a monthly rental of £6 6s 6d. Mr W. S. Armitage appeared for the plaintiff and Mr A. W. Buchlcr for the defendant. Mr Buchler said the facts, of the claim were admitted, but it was maintained by the defendant that the plaintiff was also liable under the terms of a milk contract entered into between the parties. Accordingly he entered a counter-claim for £99 18s lid, which, he claimed, he had lost through the action of the plaintiff in breaking a contract to take milk from him for a milk run. In ,the afternoon Mr Armitage said that certain of the evidence that had been brought for the defendant had taken him by surprise, and he asked for an adjournment so that ho might have evidence from the plaintiff, who was at present out of town. The case was adjourned sine die.
