FAMILY PROTECTION ACT
FURTHER PROVISION FROM ESTATE An application under, the Family Protection Act for further provision to be made out of the will of the late Benjamin Throp, retired dentist, was made before His Honour Mr Justice Kennedy in the Supreme Court this morning. • The plaintiff was Oswald Ralph Throp. and the defendants Frank Throp and others. Mr D. A. Solomon appeared for the plaintiff, and Messrs A. C. Stephens and J. M. Paterson for various defendants. Mr Solomon said he was pleased to be
able to inform His Honour that an amicable settlement had been reached among tlie parties, and a draft orde,r had been filed for approval. The estate was a very large one, having been sworn for probate purposes at £125,000, and he had been informed that it had been revalued at even a larger figure. The plaintiff was a farmer, who had formerly suffered misfortune through floods, and who had since made losses through the depression. He had a wife and six children. Counsel outlined the financial circumstances of the plaintiff. His Honour said he was glad that the members of the family had been able amicably to adjust the matter and to arrive at an agreement to consent to an order.
