TUESDAY, MAY 1. Before Mr J. R. Bartholomew S.M. DRUNKENNESS. Stephen Joseph Cunningham, a statutory first offender for drunkenness, was fined 20s, in default 48 hours imprisonment. TWO MONTHS GAOL. John Mackie appeared for sentence on a charge of obtaining on March 19 at Peebles the sum of £2 5s Id from James Gibson by falsely representing, that ho had authority from Stanley Stewart Kelly to collect the money. He faced a further charge of obtaining 11s 2d from Dan Kelly M'Kcnssie at Georgetown on March 18 by falsely representing that he had authority from George Ross of Oamaru to collect the money. | Chiof-delecLivc Young said that the accused was employed with the complainant Kelly on a threshing mill on Mr Gibson’s farm near Oamaru. After the mill had left he returned and told Mr Gibson be had authority to collect Kelly’s wages. The money was paid over by Mr Gibson. The other charge was based on similar circumstances. The accused spent the money in a drinking bout and came on to Dunedin, where lie was arrested. He was a man-led man, 33 years of age, and had two children. On account of his conduct, however, his wife had left him. The accused had been before the court previously on two charges of theft, and in March ot this year had been ordered to conic up for sentence within one year if called upon. Remarking that, in view of his record. the accused deserved no further consideration, the magistrate sentenced him to one months’ imprisonment on a charge of falsely obtaining 11s 2d and two months’ imprisonment on a charge of falsely obtaining £2 5s Id, the sentences to be concurrent.
