MOTOR COLLISION

CLAIM FOR DAMAGES Hearing was continued in the Magistrate’s Court yesterday afternoon in the case in which a claim for £B4 12s 2d was made by Horatio P. Jefcoatc against Margaret Catherine Newsou, ut Balclutha, arising out of a collision on April 16 last between a motor car driven by an employee of the plaintiff and a car driven by the defendant. The defendant said she was driving along Bay View road with the intention of proceeding on to the Portobello road. She was driving at about 20 miles per hour, but slowed down when nearing the intersection. She did not see the plaintiff’s car until she was on the intersection, and as it was then about 30yds away she carried on, thinking she had ample time to get across, ami looked to the left in case there should be auy traffic coming from that direction. She next saw the other car when it was practically in front of her. At that time she had travelled about 10yds to 12vds across the intersection, and it was‘then that the collision occurred. The plaintiff’s car must have been going at a high speed to reach her so soon, and also as after the collision it proceeded on very swiftly and struck the tramway pole. Evidence was also given by William li. Henderson, who said he was m the defendant’s car at the time of the accident. In his opinion the plaintiff s car was travelling at about 35 miles per hour as it approached the intersection, and did not reduce speed before the collision. In other respects he corroborated the evidence of the defendAn eye-witness of the accident, Mrs Adelaide Hcnsleigh, said her attention was attracted to the plaintiff s car some distance before it reached the intersection. It was then travelling at from 30 to 35 miles per hour, and did not ease up to any appreciable extent ] before the collision. She would say that the defendant’s car was first on the intersection. . . . l The Magistrate reserved his decision.
