CONSPIRACY ALLEGED
THE GARDEN CASE AN APPEAL DISMISSED Press Association—By Telegraph—Copyright. SYDNEY, June 15. The first of the appeals by the eight men who wore convicted of assaulting Mr J. Garden on May 6 was heard before Sir Justice Curlewis to-day. Counsel sought to show that there was a conspiracy on the part of certain people to cause the assault on Garden for political motives, involving the New Guard. The judge dismissed the appeal, saying: “ I am sorry I cannot increase the sentence of three months that has already been imposed.” Mr Teece, one of the counsel, caused a sensation by remarking: “I am retiring from the case as I cannot see any use in remaining as junior counsel.” Mr Owen remained in the other appeals, which have not yet been heard. OTHER APPEALS DISMISSED. SYDNEY, Juno 15. Three other appeals were later dismissed, and the remaining four were adjourned till to-morrow.
