LIBEL PROVED
CASE AGAINST WELLINGTON PAPER DAMAGES FOR SOLICITOR. [Per United Press Association.] WELLINGTON, February 24. Holding that libel had been proved the Chief Justice, in his reserved judgment in the Supreme Court, awarded £75 and costs to Mr John Joseph M'Grath, barrister and solicitor, of Wellington, against the Wellington Publishing Company in respect to the publication of a paragraph in the ‘ Dominion ’ of an episode which formed part of the proceedings at the hearing of a case in the Magistrate’s Court, in which the plaintiff appeared as counsel. In His Honour’s opinion, the report and headings, taken in conjunction, were not a fair and accurate report, and were, in his view, defamatory in themselves. The natural and plain effect of the words was to present the plaintiff as one who, in his professional conduct of the proceedings, did not behave as a gentleman. His Honour pointed out that the contrary was the case.
