CARGO FALLS FROM SLING
INJURED WATERSIDER CLAIMS £1,500

WELLINGTON, August 19,
A watersider, Joseph O’Brien, is pursuing a claim in the Supremo Court, before Mr Justice Smith, against the Dunedin-Wanganui Shipping Company arising from an accident on the Holmdale, plaintiff alleging permanent injury iu regard to which medical evidence was given assessing the injury’ at two-thirds the plaintiff’s earning capacity.
Plaintiff was struck by cargo falling out of a sling, and negligence isalleged on part of defendant iu allowing the cargo to be loaded on tho principle oi block stowing, and in failing to provide foro And aft .space of at least lift between tho fore and aft ends of the hatch coamings and the nearest cross beam. It is also contended that the omission of tho ha tollman to stop the hoist until the sling had ceased spinning contributed to the accident. Tho claim is .for £1,500. Tho defence is that the breaking of of tho sling was pure accident, and defendant himself was negligent in failing to step clear after making up the sling, also in preparing the sling, and in other ways.
