VARIOUS MATTERS DEALT WITH A sitting of tlio Supreme Court was held yesterday morning before His Honor Mr Justice Sim. DIVORCE A decree nisi was nuwlo absolute in the > divorce case of Lilian jMurray petitioner) v Cecil R Murray (respondent) The petitioner was given custody of the child, and an order was made for permanent maintenance against respondent at the rate of £.‘l a week INTERPRETATION OF WILL.
An interpretation was sought of a clause of the_ will of the late Agnes M'Dinrmid, widow, Dunedin. t<-ro -x,-.c zasd'o :->r' "-b::. avd ~ >/ &s sruL There was a second codicil in the will, and in it the testatrix incorrectly described certain of her grand-nephews, who were to benefit as nephews. She had also described their parent as Alexander M'Pherson Crier brother), whereas they were the children of Henry M'Pherson (her nephew). After legal argument His Honor decided that there was sufficient evidence of identity, and that the grand-nephews should participate in the residue of the estate, as provided_ in the will, that being the apparent intention of the testatrix.
Mr J, S. Sinclair appeared for. the executors, Mr J. M. Paterson for the grand-nephews, and Mr C. J. Payne’ for three of the nenhews. FAMILY PROTECTION ACT;
Under the Family Protection Act Mr J. B Gallon asked for an increase in the allowance to the widow of Charles Shaud, late of Balclutha, stock buyer. The executors of the will were James Smith and H. S. Reid. An order by consent was made, increasing the allowance to _ £IOO per annum.
