After legal argument His Honor decided that there was sufficient evidence of identity, and that the grand-nephews should participate in the residue of the estate, as provided_ in the will, that being the apparent intention of the testatrix.

Mr J, S. Sinclair appeared for. the executors, Mr J. M. Paterson for the grand-nephews, and Mr C. J. Payne’ for three of the nenhews. FAMILY PROTECTION ACT;

Under the Family Protection Act Mr J. B Gallon asked for an increase in the allowance to the widow of Charles Shaud, late of Balclutha, stock buyer. The executors of the will were James Smith and H. S. Reid. An order by consent was made, increasing the allowance to _ £IOO per annum.
