INJUNCTION GRANTED

IHFRIKGEMENT Of MfYBMT [Special to the ‘Star.’] CHRISTCHURCH, June 8. An injunction to restrain from further printing, publishing, selling, or otherwise circulating the publication known as tho ‘Official South Island Motorists’ Road Guido ’ was granted by His Honor Mr Justice Adams in tho Supreme Court to-day- Ihe appheuturn was made by Andrews, Bnty, and Co Ltd., against tho executive and all members of the South Island Motor Union and Martin Clmmberland Harvey, advertising agent, of Dunedin, and David M. luster, printer, of Dunedin. Tho case against the Motor Union was struck out. Mr J. K. Hutchinson appeared lor the plaintiff company, and the defendants left in the case were represented by Messrs E. W. White and R. A. Cuthbert. . For some time tho plaintiff company has • issued a publication entitled tho ‘New Zealand Motorists’ Road Guido.’ In September, 1925, another publication entitled tho 1 Official South Island Road Guide ’ was published. This was sold and circulated in Christchurch and elsewhere. Its contents, it was alleged, were an infringement of tho copyright of the ‘ New Zealand Motorists 1 Road Guide,’ inasmuch that it, contained many passages and descriptions of tours which it was alleged were copied from tho plaintiff company’s work; also tho ‘ Official South Island Road Guide ’ described itself as being official, and as being under tho auspices of the South Island Motor Union. In the statement of defence submitted by the defendants, Lister and Harvey, it was contended that they were not aware of tho existence of a copyright. It was also denied that any tours or routes described in tho ‘ Official South Island Road Guide ’ had been copied from the plaintiff company’s publication. They had not threatened or intended to infringe on the copyright held by the plaintiff company. The publication bad been compiled under the auspices of tho South Island Motor Union. The Motor Union, however, held that it was not responsible for authorising the publication of the ‘Official South Island Road Guide.’ It had merely given its approval for the publication of such a worn. His Honor granted tho injunction.
