BROWNHEART IN APPLES
RECENT TEST ACTION. APPEAL AGAINST DECISION. Frees Association —By Tolograph—Copyright, LONDON, August 20. It is understood that an appeal will be lodged against the decision in tho brownheart in apples case.—A. and N.Z. Cable. [ln July last judgment was given for the defendants in an important test action in which Messrs Bradley and Sons, Oovent Garden, claimed £4,314 from the Federal Steam Navigation Company, owners of the Northumberland, owing to the development of brownheart in apples shipped on the Northumberland from Hobart in April, 1921. The main issue of tho case was the plaintiff’s allegation that the brownheart was due to bad ventilation in the Northumberland’s hold. Tho defence Was that the brownheart was duo to inherent defects iu the apples when shipped. The defendants alternatively pleaded that tho apple cases were iiisufficiently ventilated, and they also relied on the exceptions set out in the bills of lading refuting to perils of the eea, giving the owners immunity from responsibility in the event of reasonable means Laving been taken to protect against a ship’s defects and unsoawwrthmesa.]
