SURGEON TO PAY DAMAGES
DISLOCATION OF ARM A claim against a doctor for alleged “ negligent and unskilful treatment ” resulted at Winchester Assizes lately in Mr P. J. Powell, a Southsea tradesman, being awarded £I,OOO damages. Mr Powell’s case was that from September to November, 1924, Dr Lysander Maybury, of Southsea, had treated him for neuritis in the right arm. In October, he stated, Dr Maybury, in andeavoring to break down adhesions in his right arm while he was under an anaesthetic, dislocated his arm and broke off the lesser tuberosity of Hie humerus.
On November 1. Dr Maybnry performed an operationon Mr Powell with the object of reducing the dislocation, but this he failed to do, and Mr Powell alleged that Dr Maybnry took no further steps to reduce the dislocation, although he attended him up to the middle of November. Mr Powell stated that ho had had to go into hospital and undergo a further operation on November 28. His right arm was now Sin shorter than his left, and owing to permanent inability to lift Hie arm away from the body he .alleged that he had lost the free movement and power of his right arm. . The defence was that Dr Maybnry, who is a doctor of medicine, a master of surgery, and a member of the 8..C.5., had treated his patient no differently than he had treated all his_ other patients during the whole of his forty years’ experience in surgery. , Pr Mayburi car© notice of syßSftl*
