PETITION FOR TOWN BOARD FAILS In connection with tbo petition signed by a number of Macandrew’s Bay residents, who asked that their area, be constituted a town district, tho following extracts are taken from a letter received from, t he Department ot Internal Affairs. Wellington Tho term 1 householder,’ used in section 1, Town Boards Act, 190 S, does not contemplate permanent residents in the districts. The term ‘ resident householder, used in section A, however, does contemplate permanent residents in the districts, and excludes weekenders, and the petition is insufficient unless signed by (be requisite number of those who arc ad ually permanent residents. ' Residence ’ is. ol course, an ambiguous word. and has been variously construed. The department is advised that petit loners can withdraw their signatures from the petition before the Govr'rnor-Geueral has actually take.n the step of making an alteration (or in this case creating a new town district). Ii is also considered that the signing of an objection by any person subsequent to Hip signing ol' Hie original petition by that person is in effect Hie withdrawal of bis signature from the petition. This being so, (be effect of the above withdrawal and objections is to reduce the number of signatures to the petition below that, required bisection 5, Town Boards Act, 10fW, and no further art ion should therefore he taken on the petition.”
