THE WILL OF AN EARL AN UNSUCCESSFUL APPEAL. An unsuccessful attempt to upset an ordjjr made by a judge thirty years ago,' relating to an earl’s 1,000-ycar trust, was made in the London Court of Appeal recently. it had reference to the estate of the seventh Earl of Stamford and Warrington, who died in 1883, leaving estates in Leicestershire, Staffordshire, Cheshire, and Lancashire, which were encumbered with mortgages to the extent of £BOO,OOO. , The earl created a trust tor 1.000 years, by which the rents and profits of all except the Cheshire estates, which went with the earldom, were to be devoted to repayment of these mortgages. Since then £500,000 has been paid oft , mainly from the income of the Lancashire estate. Mrs Cicely Hoare, daughter of a niece of the seventh earl, who is tenant for life of half of the Leicestershire and Lancashire estates, now appealed from an order made by Mr Justice Stirling in December, 1895, the effect of which is that the rents still go in reduction of mortgages, and the life tenants do not get a penny.' The Master of the Polls and Lords Justice Warrington and Sargant refused to give leave to appeal against this Jihirty-year-pld order.
