SENTENCED FOR BOOKMAKING
•WARRANT SUSPENDED FOR APPEAL [Per United Press Association'.] AUCKLAND, Juno 29. Judgment was given by Mr Poynton, S.M.. in the Police Court in a case in which AVilliam G. Brown, a linesman, was charged on eight informations with betting wth Constable Brown. As lie bad been orginally charged with carrying on tho business of a bookmaker, he objected to the magistrate IVnring the other charges, on tho ground that lie intended to elect to bo tried by a jury before the Supremo Court op the charge of carrying on the business of a bookmaker, and he questioned the right of the prosecutor to substitute summary charges to defeat the major charge going before the Supreme Court. The Chief Justice hud refused his application for a writ of prohibition, and accordingly Air Poynton delivered judgment. Ho held it proved that accused was a bookmaker who betted ‘‘tote” odds with tho constable, also that there was evidence of system. Brown was found guilty of one charge, and the magistrate said it was not a case for a fine. Accused had been fined £3OO a year ago, but it would appear that tho fine had no deterrent effect. Ho inflicted a sentence of thirty-two days. Security for appeal was fixed at £2O, and the warrant was suspended and the other cases adjourned pending any appeal.
