“MOUNTAIN GOD’S” WIN
“LOST £12,000 IN' THREE YEARS.” At tho Darlinghurst (Sydney) criminal sessions recently George Daniel Nightingale and Arthur Moore were charged with conspiring to defraud one Agnew. The Crown case was that Nightingale and Moore put their heads together with the object of “taking down” Tvo Agnow, a grazier, of Tasmania. Nightingale, who had been introduced to Agnew as a Bathurst pastoralist, told the Tasmanian that ho had £3,000 to £IBO for “each of us” on Mountain God for the Grand National. Both Moore and Agnow agreed to take the bet. Agnew gave bis cheque, but payment was stopped in Tasmania on his instruction. Mountain God won. but Agnew received no money in connection with, his waver.
In a statement from the dock Nightingale said that he arrived from England three years ago, and because of horse racing and drink he had lost £I2IOOO in that period. “ That’s all the pood I have done at horse racing,” added the witness. Ho did intend to put the money on Mountain God, but ha never had a chance to do so. He handed the cheque to a bookmaker, with a request to rush if, through. He intended to act honestly with Agnew, and at the detective office ho advised him to back Mountain God. Moore also made a statement. Ho denied the allegations.
The judge interrupted the address of Mr Meagher (who defended) to uphold counsel’s contention that there was no case against, the accused. There was no evidence to show that there was any criminal intent, ns the cheque for £IBO had been stopped prior to the running of the Grand National. Neither was there anything to show that if the money had been received they would not have put it on the horse.
Tim judge then directed the jury to acquit, and both the accused were discharged.
