KINDNESS LEADS TO COURT

AN EXPENSIVE CIGARETTE. Kindness of heart was the cause of James Riddell appearing before Mr J. R. Bartholomew, S.M., in the City Police Court this morning. Yesterday afternoon some prisoner? were working in front of fhe Dunedin Prison, and Riddell, who was passing, thought of Ids own freedom, and expressed his sympathy by massing a cigarette to one of 11 is Majesty’s boulders. He was seen in the act, and as it was an offence under the Prisons Act, was brought before the court to-day. Mr A. C. Hanlon, for the accused, said that it was a venial offence. In a case like this a man allowed his heart to run away with his judgment. He had cigarettes in his pocket, and, seeing the prisoners, he gave one. It was not a terrible thing, after all. Senior-sergeant Lewin, in reply to tho magistrate, said that the prisoners did not get a ration of tobacco. The Magistrate said lie thought it was an unconsidored act on the part of accused, and fined him 20s, with the alternative of seven days’ imprisonment.
