Mather, having received a crossed cheque •for £IOO, forwarded it to the Bank of Ajw.lvlla.sia at Petersham, with niftructions that it be placed do Mis Mather's account. Subsequent inouity elicited the fact l.hat the cheque, had not, been received by the. Bank of Austra-laiui, but it had been presented at the defendant bank and paid across tho counter. As the cheque had been crossed by two somewhat Jight parallel hues rum ing transversely across the cheque, it was contended that the defendant bank should not have cashed it.
