WIFE'S LOAN TO A HUSBAND.
The question of whether a wife could recover from her husband monevNraised by her on her property and lent to him was the issue in a case before Mr Justice Walton in the King’s Bench Division, London. he plaintiff was Mrs Alice Gregory, liv'«g at Muswell Hill, and the defendant Mr John \\ iliiam Gregory. She sued to recover £SOO raised by her on mortgage of separate estate settled on her by her husband and lent by her to him, he giving her an lOU and 1,000 shares in a company. Mr J. B. Matthews, counsel for defendant, argued that the action could noo be maintained, because the wife was in a position of surety, and conld go into a court of equity and ask hex husband to relieve her by paying off the mortgage as soon as the mortgagee was in a position to claim the money. In giving judgment for Mrs Gregory for the amount claimed, His Lordship said the husband was entitled to be indemnified against any claim by the mortgagee, and ordered that if the money were paid into court before April 30 the husband should be discnarged from further liability, the money to remain in court as security for the payment due under the mortgage deed.
