The parties aw the adjoining owners of the old frontage of the Hutt River, which has since depositee an alluvium. The. Chief Justice - decided that to allocate-,alluvium and a new frontage by simply extending the side-line boundaries of adjoining properties was not fair. He adopted a mode of allocation which practically amounts to ascertaining the measurement of the new frontage and of the old, then allotting to each owner an amount of the new frontage (with intervening alluvium), proportionate to what he held on the old frontage. Judgment will be entered, on this principle, and under it the plaintiffs succeed in the greater part of "the land claimed.
