WELLINGTON, November 2,

Tho Chief Justice delivered judgment this morning in the Naylor ease of Whittington v. Cohen, an action under the Local Bodies’ Contractors Act for a refund to the Napier Hospital Trustees of moneys paid to the defendant while trustee tor the supply of goods and for penalties. Plaintiff sought to recover £176 11a lid as the amount of thirty-two payments to defendant by the Napier Hospital Trustees in contravention of the Local Bodies’ Contractors Act, 1885, and £320 as the aggregate of thirty-two sums of £lO each alleged to be recoverable in respect to the thirty-two transactions as to which payments were made. His Honor gave judgment for defendant, with costs. The Chief Justice to-day gave judgment making absolute the rule nisi granted by himself in 1891, and quashed the conviction of Mr Jellicoe by District Judge Kettle for contempt of court, on the ground that the district judge had no jurisdiction.
