CHARTER-PARTIES.

A clause known In charter-parties as the cesser clause, whioh aims at tempting the liability of a charterer of a ship as soon as her loading is completed, glring her “J‘ en ®“ the cargo* for freight and demurrago. has been the subject of a suit tomb* J“fthe Dunlop and Sens, of Glasgow, OWBe S 91 *f. e Iron ship Clan Mackenzie, and MBSsra Balfour, Williamson, and Co.. Liverpool, well known as Californian merchants, and who naa Sbßtotd «» Oto toj » cargo of coals at Sydney for San *ra“oi ß oo_ The shipowners sued the charterers detention at port of loading, a “d Sf fence was that under the cesser clause the suit should be against the o° n8 jB“ 0 ® 8 oarvo and this point was argued before Justices Lawrence and Wright, sitting as a Divisional Court in the Queen sßanchDivlsion. who decided that the cesser clause did not preclude the owner from bringing an action against the charterers for damages on account of delay in loading the vessel at Sydney, and this decision has bsen confirmed by the Master of the Bolls on appeal. The point appears to be that such detention does not come under the he»d of "demurrage” in the legal sense of tho term, this term applying only to extra time specifically allowed in the charter-party for loading or discharge ai an agreed rate per day. This decision, as was pointed out in its delivery, only confirms previous legal decisions on the point, but shipowners and charterers will both do well to bear in mind this limitation of the construction frequently put upon the “ cesser clause.
