AiU-'friVE Ij.\NOi:Af!K.— Jews lidllnvn was charged with using abusive and insulting language towards James Yeoman. Mr J. A. 1). Adams appeared for the co.r.phinant, and Mr F. \V. Tlatts for defendant.—The complainant stated he was employed as sexton by the Port Chalmers Borough Council. On the forenoon of January 27 he was working inside the cemetery, when the d* Pendant commenced to cut some grass on the Town Belt. He told defendant to let the grass remain, or pay for the same. Defendant then com menced to hoot him, and then went away, but returned again in the afternoon, saying that ho was going to cut some more grass, and had the money in his pocket, and asked witness to ccme and take it out. He then made use of most abusive language towards witness. After cutting some grass he again came close to witness, made me of most disgusting language, and threatened to put lomcthing through witness's head. At the time a man named Campbell was working in the cemetery. By Mr Platts : Ho had an agreement with the Corporation for the sole right to all the grass growing on that part of the Belt. He had previously quarrelled with defendant, but had never threatened to shoot him, nor did he threaten to kick him off the Belt.—John Campbell stated that on the afternoon of January 27 he was working inside the cemetery. Heard complainant tell defendant not to cut the grass, or else to pay for the same. He was at a great distance, and may not have heard all that was said. Mr Platts submitted that there was not suflicicnt evidence to support the complaints, and that complainant had brought any bad treatment he had received on his own head. He was about t> put defendant into the. box, when Hi:) Worship said that he thought the evidence did not support the wording of the new Act, which stated that the language mint be made use of in the hearing of passers-by, whereas the old Act referred simply to a public place. The case would therefore be dismissed.
