♦ SUPREME COURT.-IN BANCO. (Before Hia Honor Mr Justice Williams.) Dodd v. Read.—Motion to dismiss action for want of prosecution. Mr F. Chapman appeared in support of the motion, and directed the attention of the Court to facta set forth in the affidavits which indicated that the suit had been prac tically abandoned. His Honor ordered that the suit be dismissed unless the next step be taken within three days after service of the order on the plaintiff—the plaintiff to pay the casta of the present motion in any event, and the costs of the action in case he does not take the necessary step to prosecute it. James Campbell v. Lewis John Lucas and Benjamin Brown.—Motion to dismiss action for want of prosecution. Mr Lewis appeared for the defendant Brown, and move under the 408 th and 417 th rules of the Supreme Court for the dismissal of the action, which had been brought under the "Summary Procedure on Bills Act, 13G2." Mr Lewis said that under the 3rd eection of the Act His Honor bad given leave to Brown to plead, that the order was ■erved on the plaintiffs solicitor, that no ■tep had been taken by the plaintiff since the issuing of the writ, and that notice of the present application had been served.
