THE COURTS—TO-DAY.
SUPREME COURT.—IN BANCO.
(Before their Honors Mr Justice Johnston andMr Justice Williams.)
Richmond v. Hepburn. Argument of rule nisi for a new trial. Mr Macasaey, with him Mr Mouat, moved the rule absolute; the Attorney-General, with him Mr Haggitt, to show cause.
The Attorney-General raised the preliminary objections that the rule was not obained in time, and that the order extending the time had been obtained ex parte and was therefore a nullity. Their Honors suggested that, as the point involved was the same as that in the recent case of Smart v. Brogden, which was going up to the Court of Appeal, it might be well to wait until that Court's decision in ths latter case was given. After discussion it was agreed that the case be adjourned until after the sitting of the Court of Appeal. The Court adjourned till Monday, at 11 a.m.
