The following are the grounds upon which the Court of Inquiry based its decision :—(1.) That, whereas Capt. Graham estimated the distauco run at the time of striking at fifty miles, tho actua! distance was sixty-six miles, although the vessel must have been art back seven or eight miles by a strong adverse tide, therefore she must have been going fully 8* knots instead of 5} knots, a difference which any seaman ought to have perceived. (2.) That, although Capt. Graham stated he had hauled m the log several times, the seamen, who were in a position where they could hardly have failed to : ee him, did not see him do it ; ana (3) that Capt. At a recent sitting of the Essidout Magistrate's Court at Nelson, re the wreck of the nbove ship, Mr Pitt asked whether tho Court considered its decision anything more than a report to the Board of Trade in England through the Governor. He cited the Merchant Shipping Act of 1854 to prove that the Court cruld only suspend a certificate granted by the Board of Trade uutil the decision of tlie Board of Trade upon the report of the Court, if confirmed by the Governor, was made known.
