RESIDENT MAGISTRATE'S COURT.
Tins Pay. (Before A. Chetham-Strode, Esq., R.M.) DRUNKENNESS. Mary Jane Gibbs, and John Briggs, were each lined 40s and costs, or one week’s imprisonment, for drunken and disorderly conduct. Civil Cases. Donollon v. Findlay.—A claim for L 4 18s, for groceries alleged to have been supplied. Mr Ward for the plaintiff.—The defendant pleaded not indebted to the amount claimed. He said that the plaintiii’s wife could not keep accounts, that the goods alleged to be groceries were in reality drink supplied, and
that the plaintiff had stated he should enter them in his books as groceries, and then the account would stand the test of any court in the Colony. The groceries supplied were paid for every Saturday night. The Magistrate felt convinced, as Car as the evidence went, it was in favor of the plaintiff ; and judgment was given for the amount claimed, with costs.
Williams v. Moore. —This was an action to recover the value of a buggy-pole that was broken by the defendant, on a journey to Port Chalmers. The defendant admitted having broken the pole, but pleaded that it .was not sound, and that the charge for a new pole was excessive, as it was agreed by Mr Robin, coach-builder, to be put in for less than L2. This the plaintiff made no objection to, but instead of the buggy being sent for repair to Mr Robins, it was sent to Mr Fish, and three pounds was charged. His Worship thought the p'aintiff's proceedings were somewhat strange. The defendant had done all that the law required in arranging to have the damage done repaired. He had a right to choose his own workman. According to his promise, he went down the day after the accident occurred, and did a'l he could to have the work done in a reasonable time. The plaintiff first agreed to bis arrangements, and then employed his own tradesmen. Under the circumstances, he could not hold the defendant liable. Verdict for the defendant.
