COLLAPSE OF WALL
NAVAL BASE ACCIDEMT
Portion of a concrete wall which collapsed at the Shelley Bay Naval Base on July 5, 1944, injured Jack (also known as Ivan) Stanicich; labourer, 23 Jessie. Street, who was clearing 'debris which had been left alongside the wall by a bulldozer. He claimed to have suffered a fracture of the right collarbone severe bronchitis, and neuritis of the left shoulder, and by petition of right sought from the Crown £900 general damages and £224 14s 6d Special damages (£lB6 9s loss of earnings and £38 5s 6d hospital expenses). When the case was called in the Supreme Court today for trial by jury, however, counsel for the suppliant (Dr. O. C. Mazengarb) announced that the parties had agreed that judgment be entered by consent for £641 8s 6d. He had to say, in fairness to the Crown, said Dr. Mazengarb, that the suppliant's allegations of negligence were disputed, and the consent was not to be taken as an admission by the officers of the Crown of any negligence. •Judgment was entered by Mr. Justice Johnston. Mr. J. Prendeville appeared for the Crown.
