ORDER TO BE QUASHED
Remarking that the position seemed to have been misunderstood by the committee, the Chief Justice (Sir Michael Myers) today directed the quashing 'of an order made by the Wellington Industrial Man-power Committee in a case under the Industrial Man-power Emergency Regulations. It was stated that the committee had dealt with the case on the basis of suspension of employment instead of termination of employment, for which permission had originally been given by a man-power officer. Dr. N. A. Foden, who appeared for the Crown, remarked that it seemed to have been simply an excess of zeal on the part of the committee. His Honour: After all, these gentlemen are all laymen, I suppose? Dr. Foden: Yes. His Honour: All laymen performing an important public service, and it is not to be wondered at in times like these, with all these different regulations, some of them difficult to construe, that an occasional error arises. Perhaps the wonder is that more do not arise.
