A retrial of Robert .James Smith, foreman stevedore, on a charge of theft involving two bolts of suiting, valued at £146, the property of the Federal Steam Navigation Co., was started in the Supreme Court on Wednesday afternoon before Mr. Justice Blair and a jury. The accused was alternatively charged with receiving the goods knowing them to have been stolen. At his previous trial the jury failed to agree and a retrial was ordered. The jury again disagreed, after a retirement of 5| hours, and Mr. Cunningham applied for a second retrial at the next criminal sittings. Mr. W. H. Cunningham prosecuted and Mr. R. I. M. Sutherland appeared for the accused.
