TRUCK DRIVER'S OFFENCE
Twelve months' imprisonment was the sentence imposed by Mr. J. L. Stout* S.M., in the Magistrate's Court yesterday upon Harold James Kelly, 23, a truck driver, for converting to his own use a mo tor-van, valued at £150, the property of S. Schuster. A charge of stealing from Schuster £6 6s 4d was dismissed. Kelly pleaded not guilty, and was represented by Mr. "R. Hardie Boys. The police evidence was that Kelly drove the van for his employer, Schuster, who was a baker, and that he took it into the city from Miramar with his work for the day still unfinished and abandoned it. When it was x recovered there was no money in it. The defence was that Kelly, feeling unwell, decided to go to the City to have a drink. He parked the van, leaving the money on the seat Urt«l«r £ coat, and, had several drinks, ifter which he realised he was unfit to drive. He had more drinks, sp«nt the night in'a hotel, and next day notified the police about the van. He admitted civil responsibility for the low of the money, but denied stealing it, and denied converting the van.
