COMPENSATION AWARD

ELDERLY CARETAKER

Compensation for four years, the amount involved being stated to be £319 17s sd, was awarded by the Chief Justice (Sir Michael Myers) in the Supreme Court yesterday to Francis Scorringe, an elderly caretaker, who was injured in October, 1938, while working in the garage premises of the Colonial Carrying Company of New Zealand, Ltd., Wellington.

A month ago, before the Chief Justice and a jury, Scorringe claimed general and special damages aggregating £2148 9s lid, the claim being based on an allegation that the lay-out of the lighting system in the garage where the accident occurred was defective and dangerous. The company denied this allegation, and his Honour dismissed the action, holding that there was no evidence of negligence on the part of the employers. His Honour awarded compensation to Scorringe today on an application brought under a section of the Workers' Compensation wAct. ' After hearing counsel his Honour said that on the evidence he would not be justified in allowing compensation for more than four years, and that, he thought, was a fairly liberal estimate to take. Scorringe was allowed 25 guineas costs and also witnesses' expenses. In the common law action which his Honour dismissed last month he allowed the company 75 guineas costs, with disbursem^its and witnesses' expenses. Mr. C. J, O'Regan appeared for Scorringe and Mr. Evan Parry for the company.
