CLAIM FOR £2000
INJURED MOTOR-CYCLIST
General damages of £1500 and £516 12s special damages were claimed in the Supreme Court today by John Scholey, a turner and fitter, of Wellington, who was injured on April 10, 1939, when his motor-cycle and a motor-car driven by Bernard Charles Whitlow, a painter, of Wellington, came into collision on the Esplanade, Petone. The case is being heard by the Chief, Justice (Sir Michael Myers) and a jury of twelve. Mr. O. C. Mazengarb is appearing for the plaintiff, and Mr. G. G. G. Watson, with him Mr. W. P. Shorland, for the defendant. The plaintiff alleged that the defendant had failed to.keep to the left-hand side of the roa/i, had travelled at an excessive speed, and had failed to keep a proper look-out. The plaintiff suffered a compound fracture of the right leg, head injuries, and shock. The special damages included £396 for loss of earnings. The defendant denied negligence, and contended that the accident had been caused by the negligence of the plaintiff in failing to give way to traffic on the right, riding at an excessive speed, and failing to keep a proper look-out. The cape is proceeding.
