COMPENSATION CLAIM FAILS
Decision in favour; .of the defendant company was given by , Mr. Justice O'Regan in the' Compensation Court yesterday -afternoon--.on a claim for compensation .made by John Frederick | Harmer, a seaman; against the Union Steam Ship Company. < Harmer claimed that while working as a member of the crew of the Waikouaiti in October last, at Sydney, he was assisting to his quarters a seamen under the influence of liquor, when the latter fell- and pulled him down a companionway. Harmer said. he was severely injured internally and would be totally incapacitated for work for some time. The company admitted that Harmfer was injured, but-contended that the injury was not received in the course of his employment. It said that the plaintiff himself was under, the influ- - ence of liquor and in a tussle witbi another seaman in the same condition he fell down the companionway. ." 'After hearing evidence the Judge . non-suited the plaintiff. , Mr. F. W. Ongley appeared for th« plaintiff, and Mr. C. G. White for the company.
