COMPENSATION COURT

Judgment in the case of Percy Foot, lorry driver, against Charles Sparrow Wycherley, contractor, both of Ashhurst, has been given in the Compensation Court by Mr. Justice O'Regan. At the hearing in Palmerston North Mr. A. M. Ongley appeared for the plaintiff and Mr. H. R. Cooper for the defendant. The accident occurred in September, 1938, when the plaintiff suffered pelvic injuries while loading logs. His Honour says: "A just and equitable settlement had,been arrived at by Mr. Ongley, and plaintiff was satisfied therewith until he discovered that the Social Security Department was claiming a refund, . . . I hold the plaintiff bound by the settlement he has arrived at for £259 9s 9d, in addition to £62 8s lOd already paid, making a total payment of £321 18s 7d, with costs £10 10s. The ■ costs are allowed because they were part of the settlement."
