(By Telegraph—Press Association.) NEW PLYMOUTH, July 3. Holding that the opening of a motorcar door had nothing to do with the driving of the vehicle, the Magistrate, Mr. W, H- Woodward, in a reserved judgment today, dismissed a' charge against Frank Collins of driving without reasonable, consideration for other persons using the road. When he parked his car Collins opened the door on the side farthest from the footpath with the result that a cyclist ran into it. The section of the Motor Vehicles Act under which the charge <f was laid was a penal one and should not be held to mean more than it did mean, commented the Magistrate. He pointed out that the door could be1 opened by a person other than the driver and in circumstances in which the car could not be held to be driven.
