COURT OF APPEAL
Decision was reserved by the Court of Appeal today in the case in which Mrs. Olive Rita Patterson appealed against an order for a new trial of the action in which she claimed damages from Dr. Kendrick Dean, of Palmerston North, alleging negligence and unskilful treatment. Damages were awarded to Mrs. Patterson by a jury which heard her claim, but Dr. Dean obtained an order for a new trial, against which Mrs. Patterson appealed.
The Court of-Appeal consisted of the Chief Justice (Sir Michael Myers), Mr. Justice Blair, and Mr. Justice Callan.
Mr. C. H. Weston, K.C., and Mr. L. G. H. Sinclair (Palmerston North) appeared for Mrs. Patterson. The doctor was represented by Mr. H. F. O'Leary, K.C., and Mr. A. W. Yortt (Palmerston North).
