CROWN'S CASE
OMISSION POINTED OUT (Br 'IVeeraph—.Press Association.) CHRISTCHURCH, This Day. A curious omission in the Crown's case against James Raywood Franks, licensee of the Prince of Wales Hotel, who was convicted of keeping premises open for the sale of liquor after hour 3, was pointed out by Mr. Justice Northcroft when he heard Franks's appeal against the Magistrate's decision this morning on the grounds that there was no evidence on which he should have been convicted in the Magistrate's Court on November 25. Franks was convicted and fined £6 for keeping a hotel open for the sale of liquor after hours. He now appealed. Although the Magistrate had found, his Honour pointed out, that liquor had been sold to a man named Prince, the Crown had not shown that Prince was not qualified as a boarder to buy liquor. Whether he was or was not a boarder was not mentioned. To give counsel for the Crown an opportunity for further consideration of the case, his Honour adjourned it until this afternodh.
