CLAIM FOR £343

ACCIDENT AT WAIKANAE

A collision between two motor-cars on the Waikanae Bridge on January 1 was the basis of a claim in the Supreme Court today, before Mr. Justice Quilliam, by Mrs. Charlotte Ella Carter, a widow, of Wellington, against Joseph Geoffrey Long, a detective, of Wellington, for £250 general damages and £93 special damages.

Mr. T. P. Cleary appeared for the plaintiff, and Mr. J. Meltzer for the defendant. The allegations against the defendant were that he drove at an excessive speed, failed to keep a proper look-out, drove with inefficient brakes, failed to stop, and drove on to a onecar bridge against the plaintiff's right of way. The injuries suffered by her, said Mrs. Carter, were a severe contusion of the right arm and shoulder, and so severe a shock that her health had become seriously impaired. The special damages included £36 6s 9d for repairs to the motor-car, and £30 for its depreciation. Negligence was denied by the defendant, who alleged that if he had been negligent there had been contributory, negligence on the part of Hugh Allen | Carter, the plaintiff's son, and thei driver of the other car, in failing to 1 keep a proper look-out, failing to stop, lack of due care and skill, driving at an excessive speed, and breaking the regulations by failing to keep as far as practicable to the left. The defendant counter-claimed for £51 5s lOd for the removal, salvage, and repairs of his motor-car. Evidence is proceeding.
