STARTLED BY DOG
A CYCLIST'S FALL
DAMAGES AGAINST OWNER

HASTINGS, This Day.
"If any dog on any highway or any enclosed place rushes out and attacks or startles any person whereby the
life or limbs of any person are endangered or any property is injured or endangered such dog may immediately be killed and the owner or keeper of such dog shall bo liable to a fine not exceeding £5 for every such offence over and above the amount of any damage occasioned by such dog."
This section of thr< Dog Registration Act was quoted by Mr. J. Miller, S.M., in a reserved decision at Hastings today in a claim for £66 0 general and special damages resulting from in-
juries to a cyclist who was startled by a fox terrier and tell. Judgment for £65 9s 9d was given-.
The plaintiff was T. A. Atkinson, Havclock North, and the defendant J. D. Heenan, Havelock North. The Magistrate said that the section of the Act quoted made the keeper of the dog absolutely liable. Costs amounting lo £8 11s were also allowed against the defendant.
