APPROACH OF POLICE

After hearing evidence today, Mr. G. N. Morris, S.M., convicted Percy William Everett, who was charged that on October 10, 1937, in order to enable Charles Thomas Arthur Clark to avoid detection, he gave Clark, a person in a common gaming-house, warning of the approach of a constable. At the last sitting of the Court last year the Magistrate gave a decision regarding certain points raised by Everett's counsel, Mr. R. K Trimmer. At the first hearing Mr. Trimmer set up that the police had not established a prima facie case, but the Magistrate considered that on the evidence as a whole a prima facie case had been established. The case was then adjourned to enable Everett to give evidence. . The defendant was examined at length today. The Magistrate said he was certain that Everett did not know he was committing an offence when he rang Clark but said he must convict. He fined Everett £5 Is, with costs 10s. Security for appeal was fixed at £10: 10s.
