LOWER HUTT PROSECUTION

A collision at-the corner of Tama and Valentine Streets; Lower Hutt, on May 6, had its sequel in the Lower Hutt Court yesterday, when James Patrick Braiden was charged with failing to give. way to traffic approaching from the-right at an intersection, and with not-having a driver's licence. He did oot appear. Sergeant J. W. McHolm conducted the. case for the: police. John Rigden Cunningham said that at; 12.30 p.m..-he was driving north up Tama Street, .and coming to the inter-! section of Valentine Street he took ex-1 tra care, as there had.previously been 8; serious accident' there. . He slowed down and? sounded his horn. He had just got on to the intersection when hei saw a car coming along at a high speed and without warning. Witness applied his brakes, but the other vehicle continued to come on, and after that he • did not remember anything else, .

Sergeant McHolm said that Cunningham's car was struck by Braiden's, and was pushed across the intersection, Striking a corner post.

Mr. H. P. Lawry, S.M., said that the results of the collision semed to indicate that the defendant's car was travelling at a higher speed than he (indicated. The defendant made no attempt to change.his course. He was lucky in not being charged with negligent driving.

A fine of £3 and costs was imposed bn the charge of not giving way, and 10s and costs on the charge of not renewing his driver's licence..
