AGENT'S APPEAL FAILS
A question of land agents' commission was involved in an appeal, judgment on which was given by Mr. Justice Johnston in the Supreme Court today. The appellant, Talbot A. B. Kirkland, appealed against the decision of a Magistrate at Lower Hutt disallowing his claim from Robert Coulter, the respondent in the Supreme Court case, for £38 15s for commission on the sale of Coulter's house and land to one Hounsell. Kirkland alleged that the sale was made through his instrumentality and by reason of his introduction of Hounsell to Coulter, but after reviewing the facts and the law of the case the Judge found that the Magistrate was entitled to come to the decision he did, and the appeal was dismissed. Mr. E. P. Bunny appeared for the appellant and Mr. J. S. Hanna for the respondent.
