The action originally was .brought, in r" the Supreme Court by Mrs. Katherine Augusta Godfrey, of Chfistchufch, ** whose; husband was killed in a. North r* Canterbury collision, against- Frank '£ Wayland Gilbert, a storekeeper, of iV Cust. The jury found -the plaintiff's n husband guilty of contributory rieglid gence, but considered. the defendant's a negligence the real cause of the acciv dent, and awarded £1500 damages for I the plaintiff, and £500 for her infant i daughter. Mr. Justice Northcroft, how- - ever, gave judgment for the defend- - ant. On August 14 the Court of Ap- • peal, by a majority verdict, upheld the » appeaj of Mrs. Godfrey against the! 5 reversal of the jury's decision.
