Judgment for the defendant was given by Mr. Justice Blair in the Supreme Court • this afternoon in the case in which Archibald John Johnstone, of Lower Hutt, claimed £826 damages from John Stanley Smith, taxi-driver, also of Lower Hutt. The case arose out of a collision at Lower Hutt on April 29, 1935, which resulted in the death of the plaintiff's son, K. B. G. Johnstone. His Honour did not call on the defence, saying that there was nothing to show that the taxidriver was negligent.
