DEEMED IN CHARGE
INTOXICATED DRIVER
PASSENGER IN OWN CAR

Although he was only a passenger j in his own car, Gustave Neilson, aged i 40, was held by Mr. H. W. Bundle, S.M., this morning to have been in charge while intoxicated and was sentenced to three weeks' imprisonment. The car, which had collided with a taxi, was driven by Jack W. Brockie, aged 25, who pleaded guilty to a similar charge, and was fined £10. His licence was suspended for a year.
It was argued for the defence that Neilson could not be convicted as he did not ■ drive at any stage, and that Brockie's admission disposed of the case, but the Magistrate held that Neilson was not so helpless as woula prevent him. from forming an opinion, and he should be convicted as allowing another intoxicated person to drive.
It was Neilson's second offence. The possibility of appeal was intimated.
