DAMAGES CLAIM FAILS

(By Telegraph—Press Association.) CHRISTCHURCH, July 3. A claim for £1466 7s 6d brought in the Supreme Court by Sydney James Green against Christchurch Cinemas. Ltd., as damages for injuries received when he fell down some steps at St. James's Theatre, was determined today by Mr. Justice Northcroft. Judgment was for defendant with costs. His Honour said Green's fall had not been caused by the steepness of ths steps. He passed through the door into a dark lavatory, assuming it to be on a flat floor, and would have fallen if the steps had been of perfectly safe design. The lights had been tampered with, and the evidence was that they had been satisfactory before they were damaged. He held that the plaintiff's accident was caused by his own negligence.
