NO JURISDICTION
LAYING OF INFORMATION
The fact that the information concerning a theft alleged to have been committed at Wanganui in 1932 had not been laid within the required period of two.years, was responsible for the remand of Patrick Joseph O'Connor, a labourer, aged 36, when he appeared before Mr. E. D. Mosley, S.M., in the Magistrate's Court today. O'Connor was' charged with the theft of £2 from Eileen O'Leary at Wanganui on May 26, 1932, but the Magistrate pointed out that as the information had not been laid within the required period he had no summary jurisdiction, and the case would have to be made an indictable one, Accordingly, he remanded O'Connor until' tomorrow.
Detective-Sergeant L. Revell said that the information had not been laid until two days ago. The accused had made a statement, however, and he asked if his Worship would accept this as evidence of a prima facie case.
The Magistrate: There is no harm in doing that.
