Hauptinann failed today in his initial attempt to avoid extradition to New Jersey to face trial for tho murder of tho Lindbergh baby when the district Supremo Court dismissed a habeas corpus writ after a hearing in which a witness positively identified lfauptmann :is the man seen ii. tho vicinity of tho Lindbergh home a few days prior to the kidnapping. Handwriting experts testified that tho ransom notes wore "undeniably" in Haiiptmanu's handwriting. Tho Court granted Hauptnianu a 48----hours' stsy of execution pending an appeal to tho Department of Justice at Washington.
