INJUNCTION REFUSED

In his reserved judgment in the Supremo Court action at Auckland, in which the owners of Kruseheu Salts, E,, Griffiths Hughes, Ltd., of Manchester, England, sought an injunction and claimed £500 damages and cosl^ against tho Alien Saline Co. (N.Z.), Ltd., manufacturers of Bhusal Gaits, Mr. Justice Hordman. dealt with the dispute in two parts. . He > awarded nominal damages to the plaintiffs on account o£ the use by the1 defendants, for a period of fourteen days, of a carton which th-e plaintiffs contended, infringed their rights, and which the defendants had abandoned before the writ was issued.

In respect of the application for an injunction restraining tho use of the name "Ehus'al" and tho defendants' red hund cartou, which was in use when tho writ was issued, his Honour said that tho plaiutiffs were not entitled to succeed., ,
